ECS (ECO CONIL SOLUCIONES, S.L. B44916997) and EcoConil as of April 2024 after the full integration of online assets to include images, website and social media. ECS remains a small business distributing high-quality products and doing restorations.

Acceptance of Terms: On accepting the quote (either verbally or online) and engaging the services of EcoConil, the client agrees to the terms and conditions outlined in this document.

Scope of Work: EcoConil will provide services as specified in the online quote (or contract) agreed upon by both parties. However, Quotes sent from our system are “estimates” based on experience under normal conditions.

Unless specifically agreed, rubbish disposal and scaffolding is not included in any quote. If this needs to be organised on the client’s behalf, a small administration fee will be charged.

If 10mm is quoted, undulations in the wall or corrective measures needed may result in sections of the walls being thicker than quoted which is normally identified before we start plastering. This is the same for plaster-boarding. Profiles are quoted assuming walls are flat and level. Additional levelling is on a time and materials basis.

Stripping process: The removal of paint and plaster to a stable substrate (~2-12mm). Occasionally, the stripping process exposes badly installed electrics, rusted metalwork, bad rendering or other damage … These issues are restoration risks and will need to be repaired on a time and materials basis.

Asbestos: Buildings built before 1986 may contain asbestos. Should asbestos be found or suspected, the material will need to be sent away for analysis and work may stop. These are unforeseen events and the client will need to pay for testing and possibly a waiting fee if it is not possible to work on other safe areas.

Polishing: Diathonite will require electrical boxes to be re-installed. Polishing requires a minimum of 20mm of Diathonite and this is too thick to use existing electrical boxes. Installation of new electrical boxes is not included in the polishing quote. Furthermore, for the polishing process, the price is an estimate, based on experience. However, billing is always T&M for polishing.

To cover very high fuel costs, billing starts when we leave our facility in Conil, and stops on our return unless otherwise agreed.

Changes to Scope of Work: Any changes to the scope of work must be agreed upon by both parties, and will result in additional costs which will be tracked under a separate project code/task in our system.

Payment: The client agrees to pay EcoConil as follows: Projects are split into agreed tasks and phases which are tracked daily. As each phase is completed it will be invoiced. Any changes to the scope of work will be clearly tracked under tasks and invoiced weekly (or the 3rd week of every month) payable within 5 days. Unless otherwise agreed normal invoices need to be paid within 10 working days or work will stop on the project. Late payment of more than two invoices may result in the client being required to pay for work in advance.

Termination: Either party may terminate the contract at any time with written notice to the other party. If the client terminates the contract, they will be responsible for any costs incurred up to the point of termination.

Materials: EcoConil will provide all materials necessary to complete the project unless otherwise specified in the contract. Due to daily changes in material pricing, this estimate has an expiry date. A deposit to cover material costs is normally required to pre-purchase materials to avoid price increases.

Liability: EcoConil will take all reasonable precautions to ensure the safety of its workers and the public. However, the client agrees to indemnify and not hold EcoConil responsible for any claims, damages, or losses arising from the project (including theft from the site).

Insurance: EcoConil has liability insurance, but the client is responsible for obtaining any additional insurance necessary for the project.

Project requirements:
• 5.7kw safe electrical connection (if not generator rental may be required)
• Supply of clean water (with good pressure) and an area suitable for washing our machines and tools
• Suitable safe parking for at least two 6m vans at the worksite
• Full access to the site at the agreed time or waiting time may be charged

Water and electricity are not the responsibility of EcoConil and any issues that stop work will result in waiting fees being charged.

Permits: The client is responsible for obtaining all necessary permits for the project unless otherwise specified.

Guarantees: EcoConil guarantees all work will be performed in a professional and workmanlike manner, and that all materials used will be of good quality. We offer a 2-year guarantee on all paid work done by EcoConil unless specified in writing. Many of our products have a 10-year product guarantee that covers the product but not the work. Our extended 10-year guarantees (subject to insurance) are only valid for a fully paid project as these guarantees are insurance-backed and separate policies need to be taken out and paid for each job when available. EcoConil reserves the right to advertise a 10-year guarantee based on this fully paid undiscounted project. EcoConil does not guarantee work not paid for, or not done by EcoConil under any circumstances, unless EcoConil is the main contractor for the project. In the event of full or partial non-payment of invoices all guarantees are rendered null and void.

Cracking: All products used have a degree of crack resistance. However, properties move and we cannot be held liable for cracking due to foundation and wall movement. This also applies to polished floors due to foundation plates moving, and the heating system running too hot and causing rapid expansion in the materials.

Intellectual property: All our quote includes a discount in exchange for EcoConil, and EcoConil alone (no employees or subcontractors) using non-identifying images of the work EcoConil does for advertising purposes. Should you object to this please let us know before accepting this quote.

T&C: We work constantly to improve our services and develop new products. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices to keep you informed and protect our business from fraudulent behaviour. We reserve the right to make changes to our T&C at any time which can be viewed at: https://ecoconil.com/tc-privacy-policy/ which supersede all others.

Disputes: Any disputes arising from the contract will be resolved through arbitration in accordance with the laws of the jurisdiction in which the project is located.

Governing Law: This contract will be governed by the laws of the jurisdiction in which the project is located.
